TERMS & CONDITIONS
The term ‘Monartti’, ‘us’, ‘we’ or ‘our’ refers to Monartti Ltd. The term ‘you’, ‘your’ or ‘yours’ refers to the user or viewer of our website. You must be 18 years of age or older to purchase goods from the site. If you are under 18, you may use the site only with the involvement of a parent or guardian. Your use of and registration on the site is void where prohibited.
By placing an order on our website, you are entering a legally binding contract. Once you have completed an online purchase, we will send you an email acknowledging your offer to buy and confirming the order details. Please note, that this is not an ‘Order Acceptance’ from Monartti Ltd. There will be a legally binding contract between you and us, for us to sell and you to buy the goods referred to in your order once the goods have been dispatched, unless we have notified you that your order is not accepted or you have cancelled it under cancellation policy. You will receive another email once your order is dispatched. We must receive payment in whole for the price of the goods that you order before your order can be accepted.

All orders are subject to stock availability. Payment for your order will be taken immediately and once all security and stock checks have been passed. If we are unable to fulfil your order, we will inform you of that promptly and refund or re-credit you for any amount you have paid or your card has been debited.
As all of our pieces are handmade and unique, please note that actual size, shape and colour of amber may differ slightly from the photo.
The prices payable for your order are the prices displayed on our website when you place your order. All of our prices are stated in UK Pounds (£) Sterling, plus any applicable delivery charges as set out in Delivery Information. Prices include VAT but exclude the cost of any other taxes, duties or charges imposed or payable in respect of goods, all of which must be paid by you.
You undertake that all details that you provide to us will be correct, that the credit or debit card used belongs to the person submitting the order and that there are sufficient funds or credit facilities to cover the sums payable. We reserve the right to obtain validation of any credit or debit card details before accepting any order.
Please see our Delivery Information page for information on timings and costs of delivery. We will use our reasonable endeavours to deliver the goods or services within the times indicated. However, where delivery times and dates are given, they are for general guidance only and we will not be held liable for late delivery of goods caused by circumstances beyond our reasonable control.
We will deliver the goods to the delivery address stated in your order. You are responsible for making arrangements to receive the goods and if the goods are held at the post office or other delivery company's depot because no one was available when the goods were delivered then it is your responsibility to swiftly collect the goods You will become responsible for the loss or destruction of or any damage to the goods after they have been delivered to the delivery address in your order or to you.
If you fail to provide us with a correct delivery address or do not accept delivery of the goods or we are unable to deliver them when we try to do so then, unless that is due to our fault, we will without affecting our other rights arrange for storage of the goods until you arrange for them to be re-delivered to you or collected by you. If the goods are not collected or delivered within 7 calendar days of the date on which the first delivery was attempted, we may terminate the Contract by notice to you and refund the price of the goods paid by you, less the delivery charges, as soon as possible but in any event within 28 days.
Please note that we are currently not able to deliver to P.O. Boxes or military bases. Monartti Ltd cannot guarantee that the sale and delivery of its goods to your particular country or location is permissible, so please be aware of your own geographic import restrictions.
Please note that any duty and/or administration charges incurred by your parcel being delivered overseas will need to be settled by you as we will not be held liable for these.
RETURNS, CANCELLATIONS AND COOL OFF PERIOD
Customers are legally entitled to cancel an order within 7 working days of receipt of the product and to return it for a full refund of the cost of the goods. Delivery charges will also be refunded if we have failed to deliver the correct item ordered. However, our absolute satisfaction promise extends your ability to return any unsatisfactory online purchases for up to 21 days.
All returned items must be unworn and in pristine condition, placed in their original presentation box and include despatch note with a reason for return, and we will be happy to exchange or refund.
If you have received the item as a gift, you can return it to us within 21 days of receipt of the product(s) provided the item(s) is/are unworn and in their original presentation box(es) and we will issue you a gift voucher credited with the cost of the item(s).
Regrettably, for hygiene reasons pierced items, such as earrings cannot be returned unless they are defective or faulty.
If you make a mistake and or change your mind after placing an order, you can cancel it at any time before we dispatch it by emailing us firstname.lastname@example.org but please contact as soon as possible. As we ship quickly it may not be possible to stop your order, so please follow the instructions for in those instances. Please follow these instructions for exchanges as well. We realise this means two transactions on your credit card but feel it is faster for you to get the product you would like.
We reserve the right to cancel an order if:
- we have insufficient stock to met your order
- one or more of the goods you ordered was listed at an incorrect price due to a typographical error
If we do cancel your order we will notify you by email and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 28 days of your order. We will not be obliged to offer any additional compensation for example for disappointment suffered.
GUARANTEE & REPAIRS
All Monartti products carry a 6 months guarantee from the date of purchase. This means that Monartti guarantee to replace or repair your jewellery should there be a defect due to original workmanship. This guarantee does not cover product damage that may have resulted from normal wear and tear or accidental damage or mistreatment of your jewellery. This guarantee does not cover jewellery cleaning.
If you detect a fault with your jewellery within the guarantee time, you should inform us via email email@example.com and when asked return your item to our dedicated workshop at: c/o Monartii, 105 Victoria Street, St Albans, Hertfordshire AL1 3TJ
Within your email please provide your contact details (name, address, phone, email), order number and a brief explanation of the issue and repair requirements.
We aim to complete all the repairs within 10-14 days from the moment we receive it, however we cannot be held responsible for any further delays. You will be promptly notified of any delays.
Examples of defects due to original workmanship:
Faulty catch, poor soldering, poorly set gemstones, badly finished metal with sharp edges.
Examples of defects due to mishandling:
Damaged metal or gemstones due to contact with corrosive substances, scratches on the surface of metal, resin, leather or gemstones due to knocks or scratches, snapped chain, lost pendant due to poorly fastened chain or choker.
Jewellery repair outside of our guarantee
If your Monartti jewellery is damaged outside of the term of this 6 month guarantee and needs repairing, or is in need of professional cleaning or restoration, we are more then happy to provide provide you with advice and quotation.For repairs and restoration inquiries outside of our guarantee period please contact our jewellery & watch specialist directly at:

All repairs are guaranteed for 12 months. This covers workmanship and materials, and applies from the time you receive your repaired item.
A voucher code allows you to take advantage of special discounts and offers. Voucher codes are issued by email, by post, in magazines, newspapers and though other promotional literature. Voucher codes can only be redeemed online on Monartti website. Voucher codes can only be used once. Voucher codes offering a discount cannot be used in conjunction with any other promotion, coupon, discount or offer. If an order or part of an order is cancelled, the voucher code will become invalid. Voucher codes have a valid period during which they must be presented. For full terms and conditions, please refer to the terms and conditions of the specific offer.
Using voucher codes.
When you have qualifying items in your shopping basket, simply enter the voucher code in the 'Vouchers' field and click on 'Ok'. The discount or offer will automatically be applied to your shopping basket. If you have applied your voucher code but decide to continue shopping or edit your order before paying, the code will remain in your basket. You will not need to enter it again when you proceed through checkout.
Problems with applying voucher codes.
If the discount or offer has not been applied, a message telling you why will be displayed. Here are the main reasons why the discount or offer may not have been applied:
- Your order does not qualify. Please check that the items in your basket meet the offer criteria by referring to the terms and conditions. For example, most voucher codes are only valid on full price items.
- Your voucher code is not valid. You may have mis-typed the code we provided you with. Please check and try again.
- Your voucher code has already been used. Voucher codes can only be used once so make sure that you have not previously redeemed your code.
- The voucher code you used is not yet active or has expired. Voucher codes are valid for a certain period only and must be presented within that time. Please refer to the terms and conditions of the offer to check that the offer has started or that it has not ended.
Customers and visitors to the site are welcomed to submit reviews and rate our products directly on products' pages following the link 'Write a review'. All reviews are subject to our approval and we reserve the right to remove comments containing foul or offensive language.'The most helpful review' competition prize - a voucher worth £100 to be spent on any product(s) at Monartti.com. Minimum order of £150 applies.
- 'The most helpful review' competition will run throughout the year 2013, with 2 prize draws: first prize draw on 15/06/2015 and the second on 15/12/2015. Closing dates for entries will be on 01/06/2015 and on 01/12/2015, all entries received after the first closing date of 01/06/2015 will be automatically submitted for the next prize draw.
- To enter 'The most helpful review' competition you must make a purchase on our website first.
- Employees of Monartti or their family members or anyone else connected in any way with the competition or helping to set up the competition shall not be permitted to enter the competition.
- No cash alternative to the prizes will be offered. The prizes are not transferable. Winning voucher will be valid for 2 months from the date it was issued.
- Winners will be chosen by an independent adjudicator or panel of judges appointed by Monartti.
- The winner will be notified by email and/or letter within 14 days of the closing date. If the winner cannot be contacted or do not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner. The winner will also be announced on Monartti's official Facebook page
- Monartti's decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
- By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions and entry into the competition will be deemed as acceptance of these terms and conditions.
DISCLAIMER AND LIABILITY
Monartti Ltd reserves the right to change, modify or remove without notice any information on the site from time to time. While will endeavour to ensure that all descriptions and illustrations of the items on the site are as accurate as possible; however we cannot guarantee that colours in our images will be rendered correctly on different computer monitors or due to your browser limitations. Monartti Ltd will make every effort to keep the site up to date and running smoothly but cannot guarantee that this site and its contents are completely free of technical errors, viruses or anything else that may have a harmful effect on any technology and therefore Monartti takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. By using this site, you acknowledge that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with this site.
Monartti Ltd will not be liable for any indirect or consequential loss or damage, loss of profit, data, revenue, business opportunity, anticipated savings, goodwill or reputation whether in contract, tort or otherwise arising out of or in connection with the terms and conditions or use of the website.
You must use the site for lawful purposes only. If we allow you to register with us you are fully responsible and liable for all access made to the site using any password or user name that you register with us. You should keep such passwords and user names confidential at all times.
Through this website you are able to link to other websites which are not under the control of Monartti Ltd. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
In the event the goods delivered are damaged or faulty or are not what you ordered in your order or if you do not receive the goods you have ordered or the quantity delivered is incorrect you must notify us immediately in writing or by email firstname.lastname@example.org within 5 working days of the date of delivery or the date of delivery you were provided by us. If you fail to do so, we will have no liability to you in respect of the goods or their non-delivery.
Should you have a valid claim; our obligation to you will be, at your option:
- Replacement or repair of any goods that are damaged or faulty free of charge
- Make up any shortages in delivery or non-delivery of any products free of charge
- Refund to you the amount you have paid for the goods
We will not be obliged to replace or refund any goods that are damaged at any time after they have been delivered. All damaged or defective goods must be returned to us by secure means either when you make your claim or within 5 working days of the date on which you make your claim in the state and condition in which they were when delivered to you or your delivery address.
Nothing in these terms and conditions shall exclude or limit our liability for (i) death or personal injury caused by negligence (as such term is defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under applicable law.
If your use of material on this Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof.
You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.
These terms and conditions do not affect your statutory rights (if appropriate) as a consumer.
We shall not be liable to you or in breach of these terms and conditions for delay or failure to perform if the delay or failure is due to a cause beyond our reasonable control (including without limitation breakdown of equipment, strike or industrial dispute, shortage of materials or failure of or delay in receiving supplies).
Your use of this site and any contract between you and Monartti Ltd for the sale of products shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions. If we fail to enforce a right under these terms and conditions, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.
Unless otherwise stated in these terms and conditions, no part of these terms and conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.
